1. About GAMESWA

GAMESWA Private Limited ("GAMESWA", "we", "us", or "our") is a company incorporated in India, registered under the DPIIT Startup India programme. We provide a computer vision analytics and tournament broadcasting platform for amateur turf cricket in India.

2. Eligibility

You may use the GAMESWA platform if:

• You are 18 years of age or older, OR
• You are under 18 and have obtained verifiable consent from a parent or legal guardian through our OTP verification process
• You have a valid WhatsApp account on the phone number you register with
• You are participating in a cricket tournament or event at a GAMESWA partner venue

By registering, you confirm that the information you provide is accurate and complete.

3. Platform Access

GAMESWA grants you a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial purposes — specifically to view your player profile, match statistics, and highlight clips.

You may not:

• Share your account or player handle with another person
• Use automated tools, bots, or scrapers to access the platform
• Attempt to reverse engineer, copy, or replicate any part of the platform
• Use the platform for any unlawful purpose

We reserve the right to suspend or terminate access to any account that violates these terms.

4. Video Capture and Match Footage

Match footage is processed by our computer vision pipeline to detect ball tracking, player performance, and key match moments. Raw footage is not shared publicly. Processed highlight clips are delivered to your registered WhatsApp number and may be displayed on your player profile.

If you do not wish to be filmed, you must notify the tournament organiser before the match begins. Participation in the match after being informed of camera presence constitutes consent.

5. Intellectual Property

GAMESWA owns all intellectual property rights in:

• The platform, including software, algorithms, and computer vision pipeline
• Match footage captured by GAMESWA cameras at partner venues
• AI-generated highlight clips and statistical analyses produced by the platform
• The GAMESWA brand, logo, and all associated marks

You retain ownership of your personal identity and performance data. By using the platform, you grant GAMESWA a non-exclusive, royalty-free licence to use your anonymised performance statistics for internal platform improvement and research purposes.

GAMESWA will not use your name, face, likeness, or identifiable highlight clips in any external marketing or promotional material without your prior explicit written consent.

6. Tournament Organisers

If you are a tournament organiser using GAMESWA to broadcast or manage an event, you additionally agree to:

• Inform all participating players that GAMESWA cameras will be in operation and that players' data will be processed
• Display GAMESWA signage or communicate camera presence at the venue before matches begin
• Collect guardian consent for any participating players under the age of 18
• Not share GAMESWA-generated content, statistics, or clips with third parties without GAMESWA's written approval
• Pay agreed event broadcasting fees as per the commercial arrangement with GAMESWA

7. Disclaimer of Warranties

The GAMESWA platform is provided "as is" and "as available." We do not warrant that:

• The platform will be uninterrupted, error-free, or available at all times
• Player statistics, ball tracking data, or highlight clips will be 100% accurate
• All matches will be successfully recorded or processed

Cricket analytics is an emerging technology. Statistical accuracy improves over time but is not guaranteed to be perfect at any given point.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law, GAMESWA shall not be liable for:

• Any indirect, incidental, or consequential loss arising from use of the platform
• Loss or corruption of match data, footage, or player statistics
• Failure to deliver highlight clips due to WhatsApp service disruption or network issues
• Any injury or incident occurring at partner venues during GAMESWA-enabled events

Our total liability to you in connection with any claim shall be limited to the maximum extent permitted by applicable Indian law.

9. Termination

You may request deletion of your account at any time by contacting info@gameswa.com. We will process deletion requests within 30 days.

GAMESWA may suspend or terminate your access if you breach these terms, misuse the platform, or engage in conduct that harms other users or the platform.

10. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will notify registered users via WhatsApp and update the "Last updated" date at the top of this page. Continued use of the platform after changes constitutes acceptance of the updated terms.

11. Governing Law and Disputes

These terms are governed by the laws of India. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
